Our client suffered a hand injury after a fall and attended hospital for treatment. She was referred to another Health Board for surgery but there was no follow up which delayed her post-surgical physiotherapy treatment. As a result of the delay, our client suffered permanent damage to her dominant hand impacting her ability to work. We achieved settlement after extensive negotiations.

During labour and delivery our client’s shoulder became stuck (shoulder dystocia) resulting in significant stretching and damage to the nerves in his neck and shoulder (Erb’s palsy / brachial plexus injury). The Health Board defended the action but the court accepted our expert evidence and legal argument that the injury was due to negligence on the part of the treating midwife.

Our client suffered brain damage due to a lack of oxygen during labour and birth resulting in cerebral palsy. The midwives and doctors failed to detect obvious signs of fetal distress on the CTG monitors which should have resulted in earlier delivery. We acted for Mr Andrews after his partner, Ms Graham, died as a result of negligence by hospital staff within the acute assessment unit of Glasgow Royal Infirmary. The junior doctor failed to admit Ms Graham to hospital and as a result she later died due to an ischaemic bowel (reduced blood flow to the bowel).
